These Terms & Conditions ("Terms") constitute a legally binding agreement between Tripmeant ("we," "us," "our"), a travel consultancy with a registered address in Wyoming, United States, and you ("you," "your," "traveller," "customer"), the person or legal entity who visits our website at tripmeant.com, requests a quote, or confirms a booking for any travel services. By accessing our website, requesting a quote, or confirming a booking, you accept these Terms, our Privacy Policy, and our Refund & Cancellation Policy in full. If you do not agree, you must not use our services.

1. Definitions & Interpretation

In these Terms, unless the context requires otherwise:

"Booking" means a confirmed reservation of an itinerary and/or individual travel services, following our written confirmation.

"Bespoke Itinerary" means a custom-designed travel plan quoting a single total price, encompassing at least two different travel services (e.g., accommodation, transport, tours, or medical procedures) for the same trip.

"Force Majeure" has the meaning given in Section 12.

"Package" has the meaning given under the EU Directive (EU) 2015/2302 or the UK Package Travel and Linked Travel Arrangements Regulations 2018, where applicable.

"Supplier" means any third-party provider of travel, accommodation, medical, transport, or other services forming part of your booking (e.g., airlines, hotels, clinics, ground operators).

"We," "us," "our" refers to Tripmeant.

"You," "your" refers to the person making the booking and all travellers named in that booking.

Headings are for convenience only and do not affect interpretation.

2. About Tripmeant & Our Role

Tripmeant is a custom travel planning consultancy. We design and coordinate bespoke journeys across Adventure & Experiential Tourism and Medical & Wellness Tourism, alongside related support services (visa facilitation, travel insurance brokerage, and travel consultation).

We act as an intermediary between you and the independent Suppliers. The Suppliers are solely responsible for delivering their respective services on their own terms and conditions. We do not own, operate, or control any airline, hotel, medical facility, guide service, or transport provider.

IMPORTANT - EU & UK Package Travel: When you book a Bespoke Itinerary through us that includes at least two different types of travel service (e.g., hotel + trekking guide, or treatment package + transfers), Tripmeant may be considered the package organiser under the EU Package Travel Directive (2015/2302) or the UK Package Travel and Linked Travel Arrangements Regulations 2018. Where this applies:

We will provide you with the mandatory pre-contractual information and a confirmation of the package.

We are responsible for the proper performance of the package as a whole.

We hold insolvency protection for our packages as required by law (details available on request).

Where we act purely as an agent for a single component or a linked travel arrangement, we will make that status clear in your booking confirmation.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts. By making a booking on behalf of others (including minors), you confirm that you have the authority to bind every traveller in your party to these Terms, and that you are responsible for the accuracy of all information provided and for communicating these Terms to them.

4. Quotes & Bookings

4.1 Quotation All itineraries are individually quoted in United States Dollars (USD). A quote is an invitation to treat, not a binding offer. Prices are valid for the period stated (typically 14 calendar days) and are subject to availability and Supplier confirmation.

4.2 Confirmation A booking becomes legally binding only when: (a) we receive your written acceptance of the final itinerary; (b) we receive the required deposit or full payment as specified in your booking confirmation; and (c) we issue our written confirmation to you. It is your responsibility to review the confirmation immediately and notify us of any errors within 48 hours. Failure to do so may result in change fees.

4.3 Price Changes Before Confirmation Prices may alter between quote and confirmation due to currency fluctuations, Supplier cost revisions, changes in taxes, fuel surcharges, or other factors beyond our control. We will inform you of any increase in writing and obtain your acceptance before charging.

4.4 Accuracy of Information While we take reasonable care to ensure accuracy, all information on our website and in itineraries is provided in good faith. Descriptions, images, and itineraries are illustrative and may change due to circumstances outside our control. Suppliers' own terms apply to the services they provide; we are not liable for errors in their materials.

5. Pricing & What Is Included

5.1 Included Items Only the services, accommodations, activities, meals, transfers, and other elements expressly listed in the "What's Included" section of your final itinerary are covered by your payment. Anything not listed is your responsibility.

5.2 Excluded Items (non-exhaustive) Unless explicitly stated, the following are never included:

International or domestic flights to/from the trip start point

Passport, visa, and vaccination costs

Travel, medical, and cancellation insurance

Personal expenses (laundry, drinks, tips, phone calls, minibar, spa treatments)

Meals not specified in the itinerary

Optional excursions, activities, or room upgrades

Medical procedure costs, medications, or post-treatment care not explicitly listed

6. Payment Terms

6.1 Payment Processor Payments are processed through Stripe, a PCI-DSS Level 1 certified payment processor. We do not view, store, or transmit your full card details. A non-refundable payment-processing fee of up to 3% is applied by Stripe on refunded amounts and is not recoverable from us.

6.2 Schedule Unless otherwise agreed in writing:

A non-refundable deposit of 25% of the total booking price is due at confirmation.

The remaining balance is due no later than 45 days before the start of your journey.

Bookings made within 45 days of departure require full payment at confirmation.

6.3 Late Payment If the balance is not received by the due date, we may treat the booking as cancelled by you, forfeit the deposit, and apply the cancellation scale in our Refund & Cancellation Policy. We will send a payment reminder before cancelling.

6.4 Chargebacks You agree to contact us first at discover@tripmeant.com about any billing dispute. Initiating an unjustified chargeback with your card issuer may result in additional fees and delay resolution. We fully cooperate in legitimate disputes.

7. Travel Documents, Visas & Entry Requirements

It is solely your responsibility to ensure you hold:

A passport valid for at least 6 months beyond your return date

All necessary visas, transit visas, and re-entry permits

Any required vaccination certificates and health documentation

We offer a Visa Facilitation service as an independent add-on. This is an administrative support service only; the decision to grant or refuse a visa rests entirely with the relevant government authority. We accept no liability for losses arising from visa rejection, delayed processing, denied boarding, or denied entry. You indemnify us against any fines or costs we incur as a result of your failure to hold correct documentation.

Travel Advisories You are responsible for checking travel advisories issued by the US Department of State, UK Foreign, Commonwealth & Development Office, or your own government's foreign travel authority. We will not be liable for any decision you make to travel against an official advisory.

8. Travel Insurance

Comprehensive travel insurance is compulsory for all Adventure and Medical & Wellness packages and is strongly recommended for all other bookings. At minimum, your policy must cover:

Emergency medical treatment and repatriation

Trip cancellation and interruption

Personal liability

Lost, stolen, or damaged baggage and personal items

Coverage for all planned activities (e.g., high-altitude trekking, specific wellness procedures)

We offer insurance facilitation and may introduce you to third-party insurers. The insurance contract is between you and the insurer. We are not responsible for claim outcomes or the financial strength of any recommended insurer. You must provide evidence of compliant insurance upon request; failure to do so may result in refusal of participation without refund.

9. Medical & Wellness Tourism - Specific Terms

Our Medical & Wellness packages arrange logistics around treatments delivered exclusively by third-party hospitals, clinics, and practitioners. We do not provide medical advice, diagnosis, or treatment, and we do not warrant any medical outcome.

By booking a Medical & Wellness package you acknowledge and agree that:

The medical provider is solely responsible for clinical assessment, informed consent, treatment quality, complications, and follow-up care.

You will truthfully disclose your complete medical history to the provider.

You will follow all pre- and post-treatment instructions.

You have arranged adequate health insurance covering the procedure and any potential complications, including emergency repatriation.

You waive any claim against Tripmeant for medical malpractice, unsatisfactory results, or complications arising from the treatment, to the fullest extent permitted by law.

Special-category (health) data you share with us will be processed only with your explicit consent and in accordance with our Privacy Policy.

10. Changes by You (Modification)

Requests to change an itinerary after confirmation must be submitted in writing to discover@tripmeant.com. We will use reasonable efforts to accommodate changes but cannot guarantee availability or pricing. Any change is subject to:

Supplier-imposed amendment fees and any difference between the original and new price;

An administrative fee of USD 75 per change;

For date or destination changes that fundamentally alter the trip, the original booking may be treated as cancelled and the standard cancellation scale applied.

11. Changes & Cancellations by Us

11.1 Minor Changes We may make minor amendments to your itinerary without prior notice if they do not materially affect the overall nature of the trip. We will inform you as soon as reasonably possible.

11.2 Significant Changes Before Departure If we are compelled to make a significant change (e.g., change of destination, a downgrade in accommodation for the majority of the trip, or removal of a key experience), we will notify you promptly and offer a choice of: (a) an alternative arrangement of equivalent or higher standard at no extra cost; (b) a different itinerary (with a refund of any price difference); or (c) cancellation with a full refund of all monies paid for the affected elements.

11.3 Cancellation by Us (Non-Force Majeure) If we cancel your booking for reasons within our control (other than your non-payment or breach), you will receive a full refund of all sums paid, or, at your option, a credit valid for 18 months toward a future Tripmeant journey.

12. Force Majeure

We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events, circumstances, or causes beyond our reasonable control. Force Majeure includes, but is not limited to: war, civil unrest, terrorism, riot, government action, border closures, pandemics or epidemics, severe weather, natural disasters, volcanic ash clouds, strikes, lock-outs, airline or Supplier insolvency, transport network failures, and interruption or failure of utility services.

In a Force Majeure situation:

We will use reasonable efforts to re-arrange your itinerary or recover refunds from Suppliers.

Any costs we cannot recover from Suppliers will remain payable by you (which is why robust insurance covering Force Majeure is essential).

We are not obliged to provide compensation for loss of enjoyment or consequential losses.

13. Limitation of Liability

13.1 Our Liability to You To the maximum extent permitted by law, Tripmeant's total aggregate liability arising out of or in connection with any booking (whether in contract, tort, or otherwise) shall not exceed the total fees you have paid to Tripmeant for that booking. We are not liable for:

The acts, omissions, errors, or default of any Supplier, even if recommended or arranged by us.

Any indirect, special, incidental, consequential, or punitive losses (including loss of enjoyment, lost income, or emotional distress).

Losses caused by your own acts or omissions.

Any sums that are recoverable under your travel insurance policy.

13.2 Non-Excludable Liability Nothing in these Terms limits or excludes our liability for:

Death or personal injury caused by our negligence.

Fraud or fraudulent misrepresentation.

Any other liability that cannot be excluded or limited under applicable law (including, for EU/UK consumers, liability under the Package Travel Directive or UK PTRs).

14. Customer Conduct & Indemnity

You are expected to behave with courtesy and respect for local laws, customs, and fellow travellers. We or any Supplier may, at our sole reasonable discretion, refuse service or terminate your participation in a trip without refund if your behaviour:

Is dangerous, threatening, abusive, or illegal.

Is disruptive to the group or the travel experience.

Contravenes any law or regulation of the host country.

You agree to indemnify and hold Tripmeant harmless from any costs, damages, fines, or expenses (including legal fees) arising from your breach of these Terms or from any third-party claim caused by your actions.

15. Complaints & Dispute Resolution

If you encounter a problem during your journey, you must notify the local Supplier and Tripmeant immediately by phone at +971 55 305 5367 or email discover@tripmeant.com to give us the opportunity to resolve it on the spot.

Any complaint not resolved during the trip must be submitted in writing within 28 days of your return date. Complaints submitted later may not be accepted.

For disputes not resolved informally, we both agree to attempt mediation in good faith before initiating any court proceedings. For consumers from the EU or UK, this does not affect your right to bring a claim in your local courts under mandatory consumer law.

16. Intellectual Property

All content on the Tripmeant website and in our materials - including text, graphics, logos, images, itinerary designs, software, and trademarks - is owned by or licensed to Tripmeant and protected by copyright, trade mark, and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written consent. You may share our itinerary proposals privately with your travel companions for personal use only.

17. Privacy & Data Protection

Your personal data is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference. We process data in line with applicable US state privacy laws, the EU GDPR, and the UK GDPR/Data Protection Act 2018, as set out in that policy.

18. Governing Law & Jurisdiction

18.1 Governing Law These Terms and any dispute arising from them shall be governed by the laws of the State of Wyoming and the federal laws of the United States of America, without regard to conflict-of-law principles.

18.2 Jurisdiction Subject to Section 18.3, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Wyoming, USA.

18.3 Consumer Protections (EU/UK/Australia & Others) Nothing in this clause deprives you of the mandatory consumer protections of the country in which you reside. If you are a consumer resident in the EU, UK, or another jurisdiction with statutory rights that cannot be waived by contract, you may bring a claim in the courts of your domicile, and those courts will apply the consumer laws that protect you.

19. General Provisions

19.1 Entire Agreement These Terms, together with our Privacy Policy, Refund & Cancellation Policy, and the booking confirmation, constitute the entire agreement between you and Tripmeant and supersede all prior communications.

19.2 Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

19.3 Waiver No failure or delay by us in exercising any right under these Terms shall operate as a waiver. A waiver by us of a breach by you shall not constitute a waiver of any subsequent breach.

19.4 Assignment You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights to a third party provided this does not materially disadvantage you.

19.5 Third Party Rights A person who is not a party to these Terms has no right to enforce any term, except for your fellow travellers on whose behalf you have booked, who may enforce these Terms as if they were a party, subject to your authority.

19.6 Notices All notices must be in writing and sent to the email address discover@tripmeant.com (for us) or the email address you provided at the time of booking (for you). They are deemed received on the next business day.

19.7 Survival Sections relating to liability, indemnity, intellectual property, and governing law survive termination or expiration of these Terms.

20. Changes to These Terms

We may revise these Terms from time to time to reflect changes in law or our business practices. The current version will always be posted on this page with the "Effective date" updated. For active bookings, the Terms in effect at the time of booking confirmation shall apply. Continued use of our website or services after a change indicates acceptance of the new Terms for all future bookings.
